Nomad hit with $4.25m damages claim

Nomad Building Solutions has been slapped with a $4.25 million claim for damages, over delays in designing and building central facilities for Chevron’s Gorgon liquefied natural gas project.

Nomad subsidiary Nomad Modular Building was awarded a $43 million contract by the Thiess Decmil Kentz joint venture in July 2009, to build kitchens and dining rooms to cater for up to 3,000 workers, a communications building, two wet messes and 14 other administration and recreational buildings.

Nomad said the project’s complexity, late design changes by the joint venture and compliance requirements for Barrow Island had adversely impacted the first phase of design and construction.

Nomad said it had dealt with the challenges, and completed the construction of all buildings two days after the contract’s December 15 due date.

“Nomad is currently considering its position with regard to the liquidated damages claim together with any impact on the company’s half year financial results which are due to be released in late February,” Nomad said in a statement to the ASX.

“Nomad intends to resist TDKJV’s claim and has claims against TDKJV for work completed amounting to some $4 million.”

Shares in Nomad closed trading today at 16 cents, down 11 per cent from its opening price of 18 cents.

News Corp. Beats the Street as Earnings More Than Double

Global media conglomerate News Corp. (NWSA) on Wednesday saw its quarterly earnings more than double from a year earlier on the strength of growth at its cable networks both in the U.S. and abroad.

For its fiscal second quarter News Corp. reported net income of $642 million, or 24 cents a share, compared with $254 million, or 10 cents a share, a year earlier.

Revenue rose by 1% to $8.76 billion, up from $8.68 billion during the same period a year ago.

“I am confident that the significant positive momentum from these businesses will not only continue to drive News Corporation’s growth for the remainder of the fiscal year, but also strengthen the Company for growth in the years to come,” said News Corp. Chairman and Chief Executive Rupert Murdoch in a statement.

Grylls releases Palmer documents

West Australian government minister Brendon Grylls has released documents relating to mining magnate Clive Palmer which, he says, do not show a “skerrick” of evidence of impropriety.

Mr Grylls previously withheld several documents relating to Mr Palmer and his company Mineralogy after a Freedom of Information (FOI) request by the WA opposition.

Earlier this week, the FOI commissioner found his decision to withhold 17 documents was “deficient”, because he did not give “details of the reasons for the refusal”.

This prompted opposition state development spokesman Mark McGowan to accuse Mr Grylls of trying to hide something and called on him to “come clean”.

Mr McGowan had sought the documents to try to find out why the company Mineralogy was let off a $45 million environmental bond for its Balmoral South project in the Pilbara.

On Friday, Mr Grylls, who is assisting the minister for state development, released the documents which include emails, diary notes and correspondence on various aspects of the planned mine.

“This has been a long process because we have been committed to protecting the rights of third parties in relation to sensitive commercial and business information,” he said in a statement.

The WA Nationals leader said he was pleased the FOI commissioner allowed him to delete some commercially sensitive information contained in the documents and the names of some individuals.

“Unfortunately, for Mr McGowan, there is not a skerrick of information in the documents that support his wild allegations of impropriety,” Mr Grylls said.

Mr Palmer, the WA Nationals’ biggest donor, said the documents outlined Mineralogy’s concerns over the imposition of a certain bond and did not suggest anything improper.
“What’s in them is we’re writing to the government complaining about the delays which we were experiencing under the Environmental Protection Authority procedures in WA,” he told ABC Radio.

“We wrote to the government saying why is the government seeking to impose on us $250 million for which we have been exempt under the legislation passed by parliament.

“(Mr Grylls) says he’ll investigate and look into it.”

Mr Palmer said no promises or assurances were made by Mr Grylls or any other member of the government.

As a result of the whole process, Mr Palmer said the reputation of WA in the business community had “gone right down the toilet” and he expected companies to be more cautious in future communications with the government.

“We do believe the government should protect the confidentiality in the way it does business, which has been blown to all hell by Mark McGowan,” he said. Read full post…

Online trader fined $15,000 for selling flammable infant sleep bags

Online trader, Philip Robinson, has been convicted and ordered to pay nearly $15,000 in fines and costs for selling non-compliant infant sleep bags known as Grobags.

Small business owners selling children’s clothing/accessories are being warned about the need comply with Australia’s product safety labelling requirements.

“Mr Robinson supplied Grobags without the fire hazard information labels required by the mandatory standard for children’s nightwear,” ACCC chairman Graeme Samuel said today.

“His conduct prevented parents and carers making an informed decision about the garment’s level of fire risk before purchase.
